Oil and Gas Management Issues for Pennsylvania Municipalities

From signing an oil and gas lease to managing its royalty income stream after production commences, a Pennsylvania municipal authority faces many unique challenges when managing its oil and gas assets. Municipal authorities that would never consider a timber sale without the assistance of a qualified forester have nevertheless signed oil and gas leases without qualified professional assistance or, worse yet, simply cashed royalty checks without verifying that they are being paid what they are owed. Current litigation trends point to possible surcharge of individual officers and board members of municipal authorities who mismanage their oil and gas assets. The damages in many cases could be a multiple of the value of the surface. Attendees will learn more about these and other important issues in oil and gas asset management in Pennsylvania.
Municipal Recovery under Anti-Trust Laws

In recent years, there has been an increasing amount of litigation brought on behalf of municipalities and states against companies and other entities under the anti-trust laws for alleged price-fixing and bid rigging, as well as other violations of the anti-trust laws. The presenter will also address a recent survey of cases in this area and conclude with a general discussion on anti-trust laws and the practical considerations and suggested approaches in investigating or pursuing such claims.
