The Susquehanna River Basin Commission will present an informational webinar to explain the proposed rulemaking that was released in September 2016.

The Susquehanna River Basin Commission has proposed new rulemaking to amend its regulations which includes:

* New application requirements and standards for project reviews
* Modifying rules dealing with mitigating consumptive use
* Registration of grandfathered projects
* Requirements for hearings and enforcement actions

 

Application Submittal and Review
Additional information and further analyses needed during the submittal and review
process. New requirements specific to projects such as mine and construction dewatering,
water resource remediation, and abandoned mine drainage remediation facilities.

Mitigation of Consumptive Use
The proposed revisions lower the water storage standard for mitigation of consumptive
water use from 90 to 45 days, require a mitigation plan to encourage water conservation
and actual mitigation of water. The proposed rules allow for the potential requirement
for mitigation of pre-Compact consumptive use if the project is located in a water
critical area.

Registration of Grandfathered Projects
Requires projects exempt from SRBC review and approval, due to operations predating
regulations, to register within a two-year window in order to preserve this exemption.
This applies to a total of 760 grandfathered projects with an estimated water use
of 970 million gallons per day. The registration program will enable SRBC to account
for existing water uses in order to properly manage the water resources of the Basin.

Hearings and Enforcement Actions
Adds greater clarity and efficiencies to the SRBC's hearing and appeals process, and allows the Executive Director broader authority in compliance and enforcement issues.
